I was perusing several articles about Class Action, and I was amazed that the general attitude regarding Class Action remains as before It is widely accepted as a basic means within the judiciary system. Class Action is a type of court case that is brought against an employer by a group of people who assert that they have been mistreated by the company. It can be filed by one person for many persons. The advantages that a Class Action Lawsuit provides is that- 1.It hastens and also enhances the competence of the legal process and also it makes sure that the cost is not much. 2.It makes sure that the defendant must reimburse for the injuries of each person. 3.It makes sure that all the Plaintiffs obtain relief. 4.It rules out "incoherent standards" which can occur if there are verdicts of different courts. 5.It makes sure that justice is served to any division of the society. 6.It makes the legal system more responsible 7.It makes the system more evident. 8.Employers become more careful and responsible. The disadvantages that a Class Action Lawsuit provides is that- 1.It could initiate conspiracies 2.It could initiate too much propaganda and give rise to problems. 3.Class Members receive very little returns due to many members being involved. 4.There are problems regarding opting out of the case that is still under disorder I think that Class Action can initiate better judicial system, but people should not see it as a tool to connive to manipulate, there have been cases of that sort. Laborers when they work in a dangerous work environment should do everything that they can to make sure they are under reliable safety. This is very important accidents that are caused by abandon should not be made an issue. |
